Terms of Service

1. Agreement to Terms

By accessing or using TrunkFlow AI ("the Service"), you agree to be bound by these Terms of Service. If you are agreeing on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

TrunkFlow AI is a HIPAA ready mobile platform for pediatric field therapists, providing AI assisted session documentation, mileage tracking, trunk inventory management, scheduling and routing, billing integration, and clinic administration tools as a subscription based SaaS product.

3. Account Registration and Responsibilities

You must register for an account to use TrunkFlow AI. You agree to provide accurate information, maintain account security, be responsible for all account activity, ensure all providers hold valid licenses, and comply with all applicable laws including HIPAA and state teletherapy laws.

4. Acceptable Use

You agree not to violate any law, transmit PHI outside your licensed scope, reverse engineer the Service, disrupt its integrity, or use it for any purpose other than intended clinical and administrative use.

5. AI-Assisted Documentation and Clinical Responsibility

All AI generated content is a suggestion only. You retain full clinical responsibility for reviewing and approving all documentation. AI generated notes do not constitute clinical advice or treatment recommendations. TrunkFlow AI is a documentation tool, not a clinical decision support system.

6. Subscription and Billing

Subscriptions are billed monthly in advance via Stripe. TrunkFlow AI may modify pricing with 30 days' notice. Failure to pay may result in suspension after a 5 day cure period.

7. Cancellation and Data Portability

You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. You have 30 days to export data after cancellation before removal.

8. Intellectual Property

TrunkFlow AI, LLC retains all rights to the Service. You retain ownership of all clinical data you input. By using the Service, you grant TrunkFlow AI a limited license to process and transmit your data solely as necessary to deliver the Service.

9. Limitation of Liability

To the maximum extent permitted by law, TrunkFlow AI shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TrunkFlow AI, LLC from any claims arising from your use of the Service, violation of these Terms, or violation of any rights of another party, including HIPAA or healthcare regulatory violations.

11. Warranty Disclaimer

The Service is provided "as is" without warranties of any kind. We make no warranty regarding the accuracy, completeness, or reliability of AI generated documentation suggestions.

12. Agency and Third-Party Billing

Agency tier subscribers are responsible for ensuring all providers comply with these Terms. Billing with third party payors or government programs is the subscriber's sole responsibility. TrunkFlow AI does not guarantee reimbursement from any payor.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington. Disputes shall be resolved in the state or federal courts located in King County, Washington.

14. Modifications to Terms

Material changes will be communicated via email and in app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance. If you do not agree, you may cancel before changes take effect.
